外国专家证办理条件篇一

《外国专家证》是外国专家在华期间的身份证件。聘请外国专家的单位应在外国专家入境后15日之内到省外国专家局为其办理《外国专家证》，并凭《外国专家证》及有关材料在入境后30天内，到公安机关办理居留手续，可不另办《外国人就业许可证》。

一、《外国专家证》适用范围

外国专家受聘在中国境内工作，应申领《外国专家证》。申请《外国专家证》的外国专家应遵守中国法律法规，身体健康，无犯罪记录，并符合下列条件之一：

（一）为执行政府间、国际组织间协议、协定和中外经贸合同，应聘在中国工作的外国籍专业技术或管理人员；

（二）应聘在中国从事教育、科研、新闻、出版、文化、艺术、卫生、体育等工作的外国籍专业人员；

（三）应聘在中国境内的企业中担任副总经理以上职务，或享受同等待遇的外国籍高级专业技术或管理人员；

（四）经国家外国专家局批准的境外专家组织或人才中介机构常驻中国代表机构的外国籍代表；

（五）应聘在中国从事经济、技术、工程、贸易、金融、财会、税务、旅游等领域工作，具有特殊专长、中国紧缺的

外国籍专业技术或管理人员。

本条第（二）、（三）款外国专家应具有大学学士以上学位和5年以上相关工作经历(其中语言教师应具有大学学士以上学位和2年以上相关工作经历)。

二、办理《外国专家证》所需材料：

（一）未办理外国专家来华工作许可，需提交：

1、提交《外国专家证申请表》（附后，请认真填写后，a4纸打印，为避免出现识别错误，恕不受理手填表格）；

2、交验有效护照原件，提交复印件一份并加盖公章；

3、交验有效签证原件，提交复印件一份并加盖公章；

4、提交最高学历证书或专业资格证明材料复印件一份并加盖公章（外文资料需同时附中文翻译件）；

5、提交聘请单位的公函一份；

6、外国文教专家，需提交聘请单位资格认可证书复印件或提交该证书编号以及与聘请单位订立的由国家外国专家局统一印制的标准聘用合同复印件。

7、提交聘请单位营业执照或法人机构代码证复印件一份并加盖公章；

8、提交近期二寸免冠照片2张；

9、如有家属随行，交验家属的有效护照原件，提交加盖公章的复印件一份/人、小一寸照片2张/人；

10、特殊行业还需提供相关的执业许可证或其他材料。

（二）已办理外国专家来华工作许可，需提交：

1、提交《外国专家证申请表》（附后，请认真填写后，a4纸打印，为避免出现识别错误，恕不受理手填表格）；

2、交验有效护照、签证原件，提交复印件一份并加盖公章；

3、交验来华工作许可存根原件，提交复印件一份；

4、提交聘请单位的公函一份；

5、外国文教专家办理来华工作许可时未提交聘请单位订立的由国家外国专家局统一印制的标准聘用合同复印件的，提交国家外国专家局统一印制的标准聘用合同复印件。

6、提交近期二寸免冠照片2张；

9、如有家属随行，交验家属的有效护照原件，提交加盖公章的复印件一份/人、小一寸照片2张/人；

10、特殊行业还需提供相关的执业许可证或其他材料。

（三）办理外国专家证延期，需提交：

1、提交聘请单位的申请一份；

2、聘请单位与外国专家签订的延期合同复印件，文教专家聘请单位提交续签的国家外国专家局统一印制的标准聘用合同复印件。

注意事项：

1、以上材料原文如为外文需附中文翻译件；

2、护照、居留证、签证、学历证书、资历证明等复印件及翻译件，均需加盖聘请单位的公章。

3、如申请人是所在单位的法定代表人或董事，则不需提交聘用合同或委任书，另需附上公司章程、股东证明等材料。

4、办证时间：材料交齐后3个工作日内。

三、《外国专家证》的注销程序

聘请单位与被聘专家合同或服务期已满，聘请单位不再续聘的，以及因其他原因聘用单位与被聘专家解除服务关系的，聘请单位应将该外国专家的《外国专家证》回收并送省外国专家局予以注销。
